II. Rights and obligations

Users can use the essential functions of the website operated by the Service Provider after registration.

Users can use the application (EprayApp) operated by the Service Provider free of charge for 30 days after downloading and registration. After that, the conditions of Chapter VII apply.

Users are entitled to request information from the Service Provider about their stored data.

The Service Provider is obliged to provide the data on the basis of the data reporting request in accordance with the data management regulations.

 

III. Contacts

The user can keep in touch with the Service Provider in writing at the info@eprayapp.org email address.

The Service Provider shall provide the requested information by e-mail at the request of the user.

 

IV. Liability

The Service Provider excludes liability for the content of the data uploaded by the user tomorrow or the applications since he has no right or opportunity to know it. The data processing does not cover the knowledge of the data uploaded by the users, and the Service Provider does not have access to the uploaded data.

Users acknowledge that they may not use the service to process data classified as business or private secrets, protected by copyright or protected under other domestic or international law if they are not authorized to handle it.

The Service Provider is responsible for processing the data provided by the users during the registration process and any other data that comes to the service provider's attention.

The Service Provider is generally responsible for the smooth operation of the service.

The Service Provider shall not be liable if the user publishes content on the system provided by the Service Provider that is illegal, violates good morals, or commits a criminal offense. 

The Service Provider draws the users' attention to the fact that none other than the data entered into the service during the registration can be obtained from the data entered during the use, so only the users are responsible for the content of the data entered.

 

V. Copyright protection 

All content elements of the service provided by the Service Provider – website and applications – such as logos and images are protected by copyright owned by the Service Provider. Suppose the user or third party copies, distributes or sells some aspects of the service or the service itself without the permission of the Service Provider. It is obliged to comply with the civil and copyright laws in force in Hungary.

 

VI. Data protection, data management

The Service Provider strives to protect the data of the users. However, due to the nature of the service, it cannot guarantee complete security. It recommends that users use the service via HTTPS to ensure secure data transfer.

The Service Provider shall not be liable for any damages resulting from the possible loss of data.

The Service Provider acts by the data management policy during the data processing.

The Service Provider is entitled to contact the user at the e-mail address provided during the registration to send a newsletter or questionnaire in case of the user's prior consent.

The Service Provider does not provide data to third parties except for the fulfillment of the official statutory request. The Service Provider informs the users that even in the case of official data provision, it is only possible to send the data provided during the registration to the authority since the Service Provider does not have access to the data entered into the service by the users.

The Service Provider declares that it processes the users' data by the data protection regulations of the European Union and Hungary.

 

VII. Fee for the use of the service

The Service Provider informs users that the use of the service is free of charge for 30 days. Users are entitled to use the service free of charge for 30 days (trial period), during which all functions of the service are available to them.

After the end of the trial period, the service will be charged $9.99/month (nine dollars and ninety-nine cents per month) or, if other currency is charged under Apple or Google's payment policy, the amount charged in that region.

The service can be paid for in the manner set out in Apple or Google's payment policies.

Based on the payment policy, users can select the country in which they use the service from the drop-down list.

 

VIII. Discontinuation of the use of the service

Users have the right to delete their account registered with the service.

Within this setting, you can do this by clicking delete the user account button.

The Service Provider shall ensure the permanent deletion of the processed data within 3 months of the deletion of the user account.

If the user no longer wishes to use the service, they must cancel the subscription in the Apple or Google store. Deleting the app or deleting your account will not automatically result in your subscription canceling. If the user fails to cancel the subscription, he is not entitled to reclaim the amount collected by Apple or Google from the Service Provider even if he has deleted his account and no longer uses the application.

 

IX. Handling disputes between parties

In the case of a dispute between the user and the Service Provider, the procedure may be conducted before the competent authorities or courts in accordance with the legislation in force in Hungary. If the user is not a Hungarian citizen, the procedure is conducted before a court competent for the provisions of Act XXVIII of 2017 on Private International Law (Nmjtv.). In this case, the legislation governing the procedure must also be established in accordance with the provisions of the Nmjtv.

This GTC will enter into force on 5 March 2022.
